Terms of Use
Vive (Vive Club). Last updated 21 July 2026.
These terms of use ("Terms") govern your use of the Vive mobile app (the "App") provided by Vive Club ("we", "us"). They apply to the production app and to internal testing builds. By downloading, signing in to, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
These Terms cover your use of the App itself. Your membership, bookings and payments are also governed by the terms of our booking provider (Mindbody) and by the facility rules and membership agreement you accept with the facility.
Who can use the App
The App is intended for facility members aged 18 and over. You need a valid membership and login to access most features. You are responsible for keeping your login details secure and for all activity that happens under your account. Tell us promptly if you believe your account has been used without your permission.
Your account
You sign in through Mindbody's secure identity service; we never see or store your password. Keep your contact details current so bookings, reminders and account notices reach you. You may sign out at any time from the Settings screen.
Memberships, bookings and payments
System of record. Memberships, tiers, allowances, class and appointment bookings, and payments are managed by Mindbody. The App reads and displays this information and lets you book on your behalf.
Availability and pricing. Bookings are subject to availability. Where a session is not included in your membership, the price is shown before you confirm. Tier allowances reset on a weekly or monthly basis depending on the benefit.
Payments.Payments are processed by Mindbody, including where you pay with Apple Pay or Google Pay. Card details are entered and stored on Mindbody's own secure pages. Vive does not collect or store your card numbers in the App, the CMS, or our systems.
Cancellations and no-shows
How much notice you need depends on what you booked, and the App shows the cut-off and what a late cancellation costs before you confirm:
Classes, the bathhouse and the recovery lounge: more than 24 hours before the start.
One to one appointments,such as coaching, physiotherapy and IV therapy: more than 48 hours before the start, because they hold a practitioner's time.
Inside that window the booking can no longer be cancelled in the App, and not attending may be recorded as a no-show. What a late cancellation or a no-show costs depends on how the session was paid for: a session included in your membership attracts a fee set by the facility, a session you bought is forfeited, and where a payment held an appointment as a deposit, the deposit is forfeited. Any charge is set and applied by the facility under its policy, not by the App.
These are the facility's current rules and may change. The cut-off and the consequence shown in the App at the time you book are the ones that apply.
Purchases, packs and refunds
Where a service is not included in your membership you can buy a single session or a pack of sessions. A pack is credit on your membership: it books nothing by itself, and you book the sessions one at a time afterwards. Sessions may carry an expiry date, which is shown in the App.
Refunds are not processed in the App. If something has gone wrong with a purchase, speak to the team at the front desk, who can arrange it under the facility's refund policy and any rights you have under the Australian Consumer Law.
Health questionnaires
Some services ask you to complete a questionnaire before your first appointment, which may include questions about your medical history, medication and allergies. Please answer accurately and completely: the practitioner relies on it to decide whether the service is safe and suitable for you, and they may decline or change the service based on your answers.
A questionnaire is not a medical consultation and nothing in the App is medical advice. Tell the practitioner if anything changes. How this information is handled is set out in the Privacy Policy.
Services delivered by third-party practitioners
Some services are delivered by practitioners the facility partners with rather than by the facility itself. Where that applies, the App shows you the service and then hands you to that provider's own booking system. From that point the booking is between you and them: they confirm it, they manage changes and cancellations, and their terms and cancellation policy apply, not the ones above. A service shown as coming soon is not yet available, and registering your interest does not book or reserve anything.
Facility and door access
Where your membership permits, the App can unlock facility doors through our access provider (Inner Intelligence / DoorGuard24). Access may require you to be physically near the door and may be limited by tier, staffed hours, or an active booking. You must not share access with non-members, and you are responsible for the conduct of any guest you bring in. Use of the facilities is subject to the posted safety rules and staff guidance.
Acceptable use
You agree not to:
use the App for any unlawful purpose or in breach of these Terms;
share, sell or transfer your account or access to another person;
attempt to gain unauthorised access to the App, our systems, or another member's account;
interfere with, disrupt, reverse engineer, or place unreasonable load on the App or its providers;
copy, scrape, or redistribute content from the App except as expressly allowed.
Content and intellectual property
The App and its content (branding, text, imagery, editorial articles, and software) are owned by Vive Club or our licensors and are protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own membership. Third-party content and schedules (for example from Mindbody) remain the property of their owners.
Third-party services
The App relies on third-party services to operate, including Mindbody (membership, bookings, payments), Inner Intelligence / DoorGuard24 (facility access), and cloud hosting, database, content-delivery and email providers. Your use of those services through the App may also be subject to their own terms. We are not responsible for third-party services beyond our reasonable control.
Notifications
If you turn on reminders, the App schedules them on your device for sessions you have booked and events you have RSVP'd to. You can turn reminders off at any time from the Notification preferences screen or in your device settings.
Assumption of risk and disclaimers
Use of the facilities and participation in any class, session or activity is at your own risk. You should obtain appropriate medical advice before starting any exercise or wellness program. The App is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that door access will always be available.
Limitation of liability
Nothing in these Terms excludes rights you have under the Australian Consumer Law or other laws that cannot be excluded. Subject to those rights, to the maximum extent permitted by law we are not liable for indirect, incidental or consequential loss arising from your use of the App, and our total liability for any claim is limited to resupplying the App or the cost of doing so.
Suspension and termination
We may suspend or end your access to the App if you breach these Terms, if your membership ends, or where needed to protect members, staff or our systems. You may stop using the App at any time and can request account deletion (see the Privacy Policy for how).
Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the date at the top of this page. Continued use of the App after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
